DUAE (ESPD) explained: the self-declaration every bidder fills in
Updated 5 min readRead this guide in Romanian
What the DUAE is
The DUAE is a standard form created at EU level so that companies do not have to submit the same certificates for every tender. It is a declaration on your own responsibility. The contracting authority defines what it must contain in the tender documentation, and in Romania it is uploaded in SEAP with the offer.
What you declare in it
- Who you are: company details, size and legal representatives.
- Whether any ground for exclusion applies, for example unpaid taxes or contributions, or a past conviction.
- Whether you meet the selection criteria: suitability to carry out the activity, economic and financial standing (such as turnover), and technical ability (such as similar works and staff).
- Whether you rely on other entities, such as a partner or a subcontractor, for part of the requirements.
Why mistakes matter
Because it is a declaration on your own responsibility, false or inaccurate information can lead to exclusion from the procedure. A declaration you cannot back up with documents is a risk, not a shortcut.
If you take part together with other companies, each one fills in its own DUAE. A DUAE you completed earlier can be reused only if the information is still correct and valid on the day you submit.
How to fill it in without drama
- Read the data sheet first and list the exact requirements the authority asks you to declare.
- Collect the documents that prove each statement before you tick it.
- Fill in the DUAE with the contracting authority's file or the EU tool, and keep the exported file in the format the authority asks for.
- Have a second person check every figure against your financial statements and reference documents.
- Keep the supporting documents ready, because the bidder ranked first is usually asked for them.
Common questions
- What does DUAE stand for?
- Document Unic de Achiziție European, the Romanian name of the European Single Procurement Document (ESPD).
- Do I need documents when I submit the DUAE?
- Not at first. The DUAE is a self-declaration. The documents that prove it are usually requested from the bidder ranked first, so you must have them ready.
- Can I reuse a DUAE from another tender?
- Only if the information is still correct and valid on the day you submit. Always check it against the new tender's requirements.

See which tenders you can win
Licits reads every SEAP notice for construction works and checks it against your company, so you spend time only on tenders you can qualify for.
